The volume is a collection of papers on certain aspects of Indian history, historiography and culture. The papers are fundamental, insightful and path-breaking to some extent. Combining literary, archaeological, scientific and other perspectives, they cover a range of subjects stretching from ancient to modern India. The volume deals with the Greek historians, the Indian epic and Puranic tradition of historiography, colonial and cultural expansion of the Aryans, the early history of north-west India, society, trade and commerce in ancient India, economic, (...) political and cultural contacts of India with other parts of Asia in ancient and medieval periods, and the 1857 War of Independence in India. It takes up some very interesting and new subjects like role of Brahmanas in the anti-Alexander movement in north-west India and the concept of national integration in ancient India. It explores the sources of history of Uttar Pradesh and the antiquity of Ayodhya and historicity of Rama in an interesting study. In an important recent article, A. Rodger expounded a cogent analysis of ch. 84 of the Lex Irnitana and especially of the logic of its account of the limits of the jurisdiction of the duumviri . He sums up his analysis of the jurisdiction of the duumviri as follows: ‘the picture which emerges is coherent, as we should expect. The duumvir has jurisdiction in cases up to 1,000 sesterces. In such cases the plaintiff may insist on his case being heard (...) locally unless it falls into one of the exempted categories. In that event, unless both parties agree, the duumvir will have jurisdiction only for vadimonium to be made to the governor who will in turn deal with vadimonium for a hearing before the praetor in Rome. If on the other hand both parties concur, the duumvir will have jurisdiction in exempted actions of up to 1,000 sesterces, the only exception being cases where an issue of free status arises. If such an issue does arise, the jurisdiction of the duumvir is restricted to dealing with vadimonium to the governor. In cases over 1,000 sesterces the duumvir has no jurisdiction unless both parties agree. If the parties do not agree, again the duumvir has jurisdiction only for vadimonium to the governor. If, however, the parties do agree, the duumvir has jurisdiction in all matters except again where an issue of free status arises. If that issue arises, he has jurisdiction only for the vadimonium to the governor.’. (shrink)

Philosophical interpretation of the cult of Krishna (Hindu deity) and spiritual life.

At present a broad consensus may be discerned on Aquinas' ‘five ways' for proving the existence of God: either he is responding to atheism per se by means of five rational arguments, or he is not responding to any formal denial of God's existence. Both of these approaches ignore the two specific objections Aquinas raises prior to the five ways: evil is incompatible with the existence of an infinite goodness , and the world does not require an external explanation . (...) While some have speculated on the structural significance of the second objection, the first has been universally regarded as irrelevant. This, I argue, is an oversight; Aquinas' first objection is central to the quinque viae. Seen in this light, while Aquinas' five ways are not responses to atheism per se, they do address, and ultimately subvert, a specific form of disbelief. (shrink)

According to Thomas Aquinas, a sovereign government may legitimately execute sinners in pursuance of the common good. Aquinas outlines his defence of Capital Punishment in the Summa Theologica 2–2, q.64, a.2 and the Summa Contra Gentiles, Book 3, Chapter 146. Aquinas's stance on this issue is well known and his argument in favour of CP has been extensively discussed. This article will focus instead on the objections Aquinas raises to the institution of CP in the ST and SCG, along with (...) his responses to these objections. After providing a brief sketch of Aquinas's account of legal punishment, Aquinas's argument for the legitimacy of CP will then be outlined. The objections which Aquinas raises to CP will then be individually examined, along with his reply to each. After examining the underpinnings of Aquinas's objections and responses, the outline of a critique will be offered which draws upon the thought of Augustine and Karl Barth. (shrink)

In Chapter 2 of the Philosophical Fragments, Søren Kierkegaard’s pseudonym Johannes Climacus poetises about a “king who loved a maiden.” Climacus concludes this venture with a bold claim: what he has just described is “so different from any human poem” that it should not be regarded as a poem at all, but as “the wonder” [Vidunderet] which leads one to exclaim in adoration that “[t]his thought did not arise in my own heart!” In the subsequent chapter of Philosophical Fragments, Climacus (...) proceeds to offer a number of arguments against demonstrations of God’s existence, leading many scholars to conclude that he represents an unequivocally anti-rationalist perspective. Against such interpretations, this paper will seek to highlight how Climacus’ claims track those of the seventeenth century Dutch lens-grinder and rationalist philosopher, Baruch Spinoza. From this, it will be argued that “the wonder” in Climacus’ thought takes the form of an indirect, ethico-existentialist argument for the truth of Christianity’s incarnate God. (shrink)
